Welcome to EIX. These Terms of Use (“Terms”) govern your access to and use of the EIX website at eixfit.com, the EIX mobile application (“App”), and all related services, facilities, and content (collectively, “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

By creating an EIX account, purchasing a membership, booking a class, or otherwise accessing our Services, you confirm that you have read and understood these Terms and agree to comply with them. If you are accessing our Services on behalf of another person, you represent that you have the authority to bind that person to these Terms.

2. Use of Services

EIX grants you a limited, personal, non-exclusive, and non-transferable right to use our Services solely for lawful, personal fitness and wellness purposes. You agree that you will not:

  • Use the Site or App for any commercial purpose without prior written consent from EIX
  • Attempt to gain unauthorized access to any portion of our platform, systems, or networks
  • Upload or transmit any harmful, offensive, defamatory, or unlawful content
  • Reproduce, copy, modify, or create derivative works from any EIX content or materials
  • Interfere with or disrupt the integrity or performance of our Services
  • Use any automated tool, scraper, bot, or similar means to access the Site or App

EIX reserves the right to suspend or terminate access to any user who violates these Terms, without prior notice.

3. Membership & Class Bookings

Membership at EIX is subject to a separate Membership Agreement that you will be required to sign at the time of enrolment. The following general conditions apply to all members:

  • Memberships are non-transferable and valid only for the registered member
  • Class and recovery suite bookings must be made via the EIX App or website
  • Cancellations must be made at least 8 hours before the scheduled session.Cancellations made within 8 hours of the session will result in automatic forfeiture of the session credit — no refund of credits will be issued
  • Repeated no-shows or late cancellations may result in booking restrictions or membership suspension
  • EIX reserves the right to modify class schedules, session availability, and facility hours at any time

4. Health, Medical & Blood Work

EIX is a premium health and wellness facility. Certain programs, including our on-facility blood work and diagnostics service, are designed to support your wellness journey with precision and science-backed insights. Please note:

  • All health-related content provided by EIX, including diagnostic results, is for informational and wellness guidance purposes only and does not constitute medical advice, diagnosis, or treatment
  • Blood work is conducted at our facilityexclusively through certified third-party laboratory partners; results are shared only with you and authorized EIX wellness staff
  • You are strongly advised to consult your physician before beginning any fitness program or acting on diagnostic results
  • EIX does not recommend, endorse, or prescribe any medical treatment, medication, or procedure
  • Reliance on any information provided through our Services is solely at your own risk

5. Assumption of Risk & Waiver

Physical fitness activities carry inherent risks, including the possibility of injury, illness, or death. By participating in any EIX class, program, or using any facility or equipment, you voluntarily assume all such risks. You agree that EIX, its employees, coaches, and partners shall not be held liable for any injury, loss, or damage arising from your participation, to the fullest extent permitted under applicable Indian law.

You confirm that you are in adequate health to participate in physical activities and have disclosed any known medical conditions, injuries, or contraindications to EIX at the time of enrolment.

6. Intellectual Property

All content on the EIX website and App — including but not limited to text, graphics, logos, images, class programming, workout formats, videos, and software — is the exclusive property of EIX or its licensors and is protected by applicable intellectual property laws. You are granted no right, title, or interest in any such content beyond the limited use licence described in Section 2.

The EIX name, logo, and all related marks are trademarks of EIX. Any unauthorised use of EIX trademarks is strictly prohibited.

7. User Accounts & Security

When you create an EIX account, you agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the confidentiality of your login credentials and not share them with any third party
  • Notify EIX immediately at info@eixfit.com if you suspect unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

EIX reserves the right to disable any account at its sole discretion if it believes the account is being misused or has been compromised.

8. Payments & Refunds

All membership fees, class bookings, and additional service charges are payable in advance. Fees are processed securely via our integrated payment gateway and are non-refundable except as expressly stated in your Membership Agreement or required by applicable Indian consumer protection law. EIX reserves the right to revise pricing at any time with reasonable prior notice to members.

In the event of facility closure or cancellation of a session by EIX, affected members will receive a credit or rescheduling option at EIX’s discretion.

9. Third-Party Services & Links

Our Services may integrate with or link to third-party platforms including payment processors, diagnostic laboratory partners, wearable device applications, and social media platforms. EIX does not control and is not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

10. Disclaimers

Our Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. EIX does not warrant that the Site or App will be uninterrupted, error-free, or free of viruses or harmful components. To the fullest extent permitted by applicable law, EIX disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law, EIX shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or personal injury — arising from your use of our Services, participation in any class or program, or reliance on any content or diagnostic information provided through EIX. EIX’s total liability to you for any claim shall not exceed the total membership fees paid by you in the three (3) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless EIX, its founders, employees, coaches, contractors, and partners from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any third-party rights.

13. Facility Rules & Code of Conduct

All members and visitors at EIX are expected to:

  • Treat fellow members, coaches, and staff with respect at all times
  • Follow all posted safety guidelines, class protocols, and coach instructions
  • Wear appropriate workout attire and maintain personal hygiene
  • Wipe down equipment after use and return all items to their designated places
  • Refrain from consuming alcohol, tobacco, or non-prescribed substances on the premises
  • Refrain from using mobile phones during live classes unless in an emergency
  • Not engage in any conduct that disrupts the experience of other members

EIX reserves the right to remove any individual from the facility who violates these conduct standards, without refund.

14. Modifications to Terms

EIX reserves the right to amend these Terms at any time. The “Last Updated” date at the top of this page will reflect the most recent revision. Continued use of our Services following any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

16. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force. These Terms, together with the EIX Privacy Policy and your Membership Agreement, constitute the entire agreement between you and EIX with respect to the subject matter herein and supersede all prior agreements or understandings.
